1. Agreement. By accessing or using the TokClaw AI platform (“Service”), you agree to these Terms of Service (“Terms”). If you do not agree, do not use the Service. These Terms are a binding agreement between you (“User”) and TokClaw AI (“Company,” “we,” “us”).
2. The Service. TokClaw AI is an AI content creation application for social media. You provide a web address and settings; the Service reads that page, writes text hooks, sources or generates images, and assembles multi-slide photo slideshows for social platforms, using AI models operated by us and by third-party providers. Where you choose to connect a third-party scheduling account, the Service can schedule and publish those slideshows to social accounts you control.
3. Your account. You are responsible for your account credentials and for activity under your account. You must be at least 18 (or the age of majority in your jurisdiction) to purchase.
4. Acceptable use. You may not use the Service to create or distribute: content that uses or imitates the likeness, voice, or identity of any real person without their express, verifiable consent (including deepfakes and non-consensual imagery); content promoting violence, hatred, or discrimination against protected groups; sexual content involving minors; content that infringes others’ intellectual-property or privacy rights; spam or deceptive content; or content that violates applicable law. We may suspend or terminate accounts that violate this section.
5. Third-party platforms. Publishing runs through third-party services you connect with your own credentials, and posting to any social platform is also governed by that platform’s own terms, policies, and rate limits. You are responsible for complying with them and for the content published to accounts you control. We do not control, and are not responsible for, the availability, moderation decisions, or account actions of any social platform.
6. Your content and outputs. You retain your rights in the inputs you provide. Subject to these Terms and applicable third-party model and stock licenses, you may use the outputs you generate, including commercially where your license tier permits. You are solely responsible for reviewing outputs before you publish them and for your use of them.
Ready-made faces. Some features let you start a persona from a ready-made AI face supplied from our library (“Library Faces”). Library Faces, and any image made from them, are licensed to you for use only inside content you create with the Service; they are not sold to you. You may publish slideshows made with the Service that contain them, including commercially where your license tier permits. You may not extract, download, copy, sell, sublicense, or otherwise use a Library Face or an image made from it outside content made with the Service, and you may not use one to train or build any model, dataset, or product. The Service does not offer a separate download of Library-Face images; they leave the Service only inside a slideshow you make. This paragraph does not apply to personas you design yourself from traits, which remain covered by the paragraph above.
Stock images. Unless you supply your own images or generate them, the Service finds slide background images automatically, by keyword search, in third-party stock photo libraries, and uses them under those libraries’ licenses. We do not create, review, or control those images, and an automated search cannot tell what a photo shows. A library may label an image wrongly, and an image may be unsuitable for your post. We may filter out images that a library labels in certain ways, but no filter catches everything, and we make no promise that any stock image is accurate, appropriate, or fit for your post. You are solely responsible for reviewing the images in every slideshow and for what you publish. If you let the Service post on a schedule, slideshows can be published without your review; check them in your Library first, or change any image in the slide editor or use your own image set, if you want to see every image before it goes out.
7. Credits and purchases. Your plan includes a monthly allowance of credits as stated on the offer you purchased. Credits are a usage meter, not currency, and have no cash value. Purchases are processed by our authorized retailer (JVZoo) or payment processors. Your purchase is covered by a 30-day money-back guarantee as stated on the offer page; separately-purchased consumable credit packs are non-refundable, and credits consumed before a refund is processed are not recoverable.
8. Third-party models and services. Some features run on third-party AI models, stock image providers, and scheduling services, including services you connect yourself with your own API key. Your use of those features is also subject to the relevant provider’s terms, and it is your responsibility to comply with them.
9. Export controls. You may not use the Service if you are listed on any applicable government list of prohibited or restricted parties or located in an embargoed jurisdiction.
10. Disclaimers and liability. The Service is provided “as is.” AI output may contain errors or artifacts. We do not guarantee any level of reach, engagement, followers, or income. To the maximum extent permitted by law, our aggregate liability for any claim relating to the Service is limited to the amount you paid us in the twelve months before the claim.
11. Changes; termination. We may update the Service and these Terms; material changes will be reflected by the “Last updated” date. You may stop using the Service at any time; we may suspend accounts for breach.
12. Governing law. These Terms are governed by the laws of the State of Delaware, United States. Disputes shall be resolved through binding arbitration under the AAA Consumer Arbitration Rules.
